Terms of Service

These terms cover your use of LureCycle (“LureCycle”, “we”, “us”), at lurecycle.com. By creating an account or buying anything here, you agree to them. If you don’t, please don’t use the site.

1. What LureCycle is

LureCycle is a marketplace where people buy and sell used fishing tackle. We don’t own, inspect, store or ship the gear. The seller owns the item and is responsible for describing it honestly and sending it. We provide the site, take the payment, hold it, and pass it on.

2. Your account

You must be 18 or older and able to enter a contract. Keep your password to yourself — anything done from your account is treated as done by you. One person, one account. Tell us promptly if you think someone else has access.

3. Listing gear

You may only list items you own outright and can legally sell. Describe them honestly, including faults. Photos must be of the actual item.

You may not list:

  • Firearms, ammunition, explosives, or knives sold as weapons
  • Live or preserved bait, or any live animal
  • Protected, endangered or otherwise illegally taken species, or products made from them
  • Counterfeit tackle, or items infringing someone else’s trademark
  • Stolen goods, or anything you don’t have the right to sell
  • Anything whose sale is restricted where you or the buyer live

We may remove any listing, at any time, without notice. Repeated breaches cost you the account.

4. Fees

Listing is free. When an item sells, LureCycle keeps 8% of the item price plus shipping, and the seller receives the rest.

Buyers also pay a service fee on top of the listed price, shown clearly before payment. It covers card processing. It is not a surcharge levied by your card issuer.

We’ll give notice before changing fees. Changes never apply to a sale already made.

5. Payment, and how we hold it

Payments are processed by Stripe. Card details go to Stripe and never touch our servers. Sellers are paid into a Stripe account they set up and control.

We hold the buyer’s money until the seller ships. When a seller enters a valid tracking number, their share is released. This is deliberate: it means a buyer isn’t relying on a stranger’s goodwill.

If the seller doesn’t add tracking within 7 days, the order is cancelled and the buyer is refunded in full, automatically. No one has to ask. Because the money never left LureCycle, there is nothing to recover from the seller.

6. Shipping

Sellers ship at their own cost using the amount set in the listing, and are responsible for packing items properly and providing genuine tracking. Entering a tracking number for a parcel you haven’t sent is fraud, and we will close the account and may refund the buyer.

7. Returns, refunds and disputes

Talk to each other first — most problems are a misunderstanding, and LureCycle has messaging built in for exactly this.

Contact us at hello@lurecycle.com within 7 days of delivery if:

  • The item never arrived
  • It is materially different from the listing
  • It arrived damaged and wasn’t described that way

We may refund the buyer, in whole or in part, at our discretion. Sales are otherwise final — used tackle is sold as described, and changing your mind isn’t grounds for a refund.

If a buyer reverses a payment with their bank, we may recover that amount from the seller, including from future payouts.

8. Conduct

Don’t: arrange payment off LureCycle to avoid fees (it also removes every protection above); harass anyone; misrepresent items; use the site to launder money; scrape it; or try to break it.

9. Suspension

We can suspend or close an account at any time for breaching these terms. If we do, listings come down. Money already owed to you for shipped orders is still yours; money for orders that never shipped goes back to the buyers.

10. Liability

The site is provided “as is”. We don’t guarantee it will be uninterrupted or error-free. We are not party to the sale contract between buyer and seller, and we don’t guarantee the quality, safety or legality of any item.

To the fullest extent the law allows, our total liability to you for any claim is limited to the greater of the fees we earned on the transaction in question, or $100.

Nothing here limits liability for fraud, death or personal injury caused by negligence, or anything else that can’t lawfully be limited.

11. Changes

We may update these terms. If a change is material we’ll say so on the site. Continuing to use LureCycle after that means you accept the new version.

12. Governing law

These terms are governed by the laws of the State of Wisconsin, United States, without regard to its conflict-of-law rules. Any dispute arising from them will be brought in the state or federal courts located in Wisconsin, and you agree those courts have jurisdiction over you.
